In general terms, when applying for adjustment of status or consular processing, the person seeking to apply for a green card must comply with the following: (1) that his or her marriage to a U.S. citizen or legal permanent resident is legitimate: (2) that there is no legal barrier or impediment that excludes him/her from this remedy; and (3) that your stay in or entry into the United States will not pose a threat to national security.

When choosing between adjustment of status and consular processing reliefs, the location of the person seeking to obtain a green card must be considered, as well as the legal immigration status of the person seeking to obtain a green card and that of the person who wishes to petition for it.
